STORAGE YARD RENTAL AGREEMENT
In order to serve the needs of the members of the Association, to provide for the aesthetic enhancement of the community and to allow owners to store their boats, campers and recreational vehicles which may not be kept on the Lots except within a garage pursuant to paragraph 5.16 of the Declaration, Summer Sands Association provides rental space on the common area of the Association.
Please give a complete description below of the item(s) you will be storing. Be as specific and detailed as possible. This information will be used by the management company and the Association to manage our storage area and by the police should theft, vandalism, or an accident occur.
By submittal of this form, you are stating that you have read and agree to all the rules and regulations set forth in this agreement and further state that all information you have given is true, accurate and complete and that you will advise the association’s management within thirty (30) days of any change in such information. You understand the Association and/or management company will be providing me with a storage space based upon the full accuracy of the information you have given and that you agree to pay a monthly rental rate of $25 in advance on the 1st day of the month in which it is due and to additionally pay a late fee of $10 and interest at the maximum rate allowed by law for any payment which is made fifteen (15) days after it was due.
Further, should you fail to pay the above agreed rental amount and my account becomes past due for a period in excess of sixty (60) days, you understand and agree that the Association’s management company will send you written notification of such delinquency via registered mail to the address that the Association has on file for you and thereafter should you not pay all rental charges in full within fifteen (15) days the Association’s management company shall have the right to contact a private towing and/or storage company or other such company to have the item(s) you are storing, removed from the Association’s storage area and relocated to another location of said association’s management company’s choice, at your sole and complete expense.
Should it become necessary for the association to initiate any legal action against you due to account delinquency or non compliance with any of the rules and regulations set forth herein and such action shall be found in favor of the association, you agree to reimburse the association for all legal expenses it incurs in such action.
Additionally, you agree to indemnify, defend and hold the association, it’s members, officers, directors, management company and employees, harmless from and against all losses, expenses, damages and costs, including attorney fees and court costs, resulting from any violation of the rules set forth herein, or arising out of your use of the storage area or any negligence on your part or that of any third party you bring into or cause to enter the storage yard.
The provisions of Part III of Chapter 83 Florida Statutes apply to this Storage Yard Rental Agreement, to include but not limited to Section 83.805, which provides for a lien against any property stored, Section 83.8055, which provides for withholding access to property stored upon non-payment of rent and Section 83.806 enforcement of lien providing for the sale of stored property.
